1. Introduction
Welcome to Café Mambo, a lifestyle and event venue in the Cape Winelands, South Africa.
These Terms and Conditions govern the use of our website, www.cafemambo.co.za, including enquiries, package information, quotation requests and communications made through our website.
By accessing or using our website, you agree to these Terms and Conditions. If you do not agree, please discontinue use of the website.
Submitting an enquiry or requesting a quotation does not constitute a confirmed booking.
2. About Café Mambo
Café Mambo provides venue facilities and event experiences for private celebrations, birthdays, corporate functions, year-end functions and other approved events.
Our website provides information about our venue spaces, packages, services and pricing. All bookings remain subject to availability, confirmation and the applicable booking agreement.
3. Website Information and Accuracy
We make reasonable efforts to ensure that the information published on our website is accurate and current.
Package descriptions, photographs, menus, prices and promotional offers may be updated from time to time. Photographs are illustrative and may not represent the exact layout or appearance of a venue on your event date.
Availability is not guaranteed until your booking has been confirmed in writing. Certain services, entertainment, activities and package inclusions may be subject to availability, weather conditions or operational requirements.
Where a quotation or signed booking agreement contains specific terms for your event, those terms will apply to the extent permitted by applicable law.
4. Enquiries and Quotations
Website enquiries and quotation requests are provided to help prospective clients plan their events.
A quotation:
- is subject to the validity period stated on it;
- is based on the event details, guest numbers, selected package and requirements supplied by the client;
- may need to be revised if event details or requirements change; and
- does not guarantee availability unless the relevant booking conditions have been met.
Unless otherwise stated in writing, quotations are valid for 14 days from the date of issue.
Indicative availability holds, where offered, may be limited to the period communicated to the client. An enquiry, telephone conversation, WhatsApp message or verbal indication of availability does not independently guarantee a booking.
5. Booking Confirmation and Payment
A booking is confirmed only once Café Mambo has accepted the booking in writing and the applicable deposit and other stated booking requirements have been met.
Unless otherwise agreed in writing:
- a 50% deposit is required to secure a booking;
- the outstanding balance is payable no later than seven days before the event; and
- final guest numbers and event changes must be submitted no later than seven days before the event.
Any agreed additional services or charges will be reflected in the applicable quotation or booking agreement.
A booking may not be treated as confirmed merely because a quotation has been requested or issued. All payments must be made using the payment instructions provided by Café Mambo. Clients should verify payment details before transferring funds.
6. Pricing and Additional Charges
Prices are based on the package, services, date and guest numbers specified in the applicable quotation.
Additional charges may apply for extras requested by the client, changes to the booking, additional equipment, additional services or other items not included in the selected package.
Any additional charges will be communicated to the client and dealt with in accordance with the applicable booking agreement and consumer law.
Café Mambo will not intentionally misrepresent package inclusions or charge for undisclosed extras contrary to applicable law.
7. Cancellations, Postponements and Refunds
Cancellation and postponement requests must be submitted in writing. The applicable cancellation, postponement, refund and deposit provisions will be set out in the client's booking agreement.
Unless otherwise required by applicable law or agreed in writing, the cancellation deposit refund scale in Section 8 of this document applies to cancellations by the client.
Any cancellation charge or amount retained from a payment must be assessed in accordance with the applicable agreement and South African law, including applicable consumer protection requirements.
Nothing in these Terms and Conditions is intended to exclude a refund or other right that a client is legally entitled to receive. Clients should contact Café Mambo as soon as possible if they need to cancel or reschedule an event.
8. Cancellation Policy
Should a client need to cancel a confirmed booking, the following refund policy will apply to the deposit paid, calculated according to the notice period between Café Mambo's receipt of the written cancellation and the scheduled event date:
- Less than 30 days' notice: Deposit is non-refundable.
- 30–59 days' notice: 20% of the deposit paid will be refunded.
- 60–89 days' notice: 50% of the deposit paid will be refunded.
- 90 days or more notice: 80% of the deposit paid will be refunded.
Cancellation requests must be submitted in writing. The notice period will be calculated from the date Café Mambo receives the written cancellation request to the scheduled event date. This policy is subject to applicable South African law, including mandatory consumer rights and requirements concerning the fairness and reasonableness of cancellation charges.
9. Circumstances Beyond Reasonable Control
Should an event be cancelled or materially affected by circumstances beyond the reasonable control of either party, including acts of God, severe weather, natural disasters, government restrictions or other comparable unforeseen circumstances, Café Mambo will work with the client in good faith to explore rescheduling the event.
Any rescheduled event will be subject to venue availability, agreement between the parties and applicable legal requirements.
If rescheduling is not reasonably possible, the parties will discuss an appropriate resolution in good faith, taking into account the booking agreement, amounts paid, services already provided and applicable South African law.
Neither party is automatically released from all contractual obligations merely because an unforeseen circumstance occurs.
10. Guest Numbers and Event Arrangements
Clients are responsible for providing accurate guest numbers and event information.
Minimum and maximum guest numbers, venue capacities, session times and package requirements vary by venue space and package.
Clients must obtain Café Mambo's approval for material changes to event arrangements in advance.
The venue may enforce lawful capacity limits, safety requirements and reasonable operational rules. Guests may not exceed the agreed capacity or use areas that have not been allocated to their booking.
11. Catering, Decorations and External Suppliers
Unless expressly agreed in writing:
- catering must be arranged through Café Mambo or an approved supplier;
- outside catering is not permitted without prior written approval; and
- external decorations, equipment and service providers require prior written approval.
Decorations, installations and equipment must not damage the venue, its grounds, buildings, fixtures or facilities.
All approved suppliers must comply with venue access, safety, setup and removal requirements.
Clients are responsible for damage caused by themselves, their guests or their suppliers, subject to applicable law.
12. Alcohol and Responsible Conduct
Café Mambo permits bring-your-own-alcohol arrangements where expressly allowed by the applicable venue package and booking conditions.
Clients and guests must comply with applicable liquor laws, venue rules and lawful instructions from venue management.
Alcohol may not be supplied, sold, consumed or brought onto the premises in a manner prohibited by law or the applicable booking agreement.
Café Mambo may take reasonable and lawful steps to address intoxication, unsafe conduct, unlawful activities or behaviour that threatens the safety of guests, staff or other persons.
13. Safety, Conduct and Damage
Clients are responsible for informing their guests of applicable venue rules and ensuring that their event is conducted responsibly.
Guests must:
- follow reasonable safety instructions from venue management and authorised staff;
- respect other guests, staff, property and the surrounding environment;
- avoid dangerous, unlawful, abusive or disruptive behaviour; and
- use equipment, recreational facilities and activity areas only as permitted.
Café Mambo may intervene where reasonably necessary to protect people, property or the lawful operation of the venue.
Nothing in these Terms and Conditions excludes liability where such exclusion would be unlawful.
14. Children and Supervision
Where children attend an event, their parents, guardians or designated responsible adults must ensure appropriate supervision.
Children must use play areas, recreational facilities and equipment in accordance with applicable safety instructions and age or height restrictions.
The availability of child-friendly facilities does not replace the responsibility of parents or guardians to supervise children.
15. Photography, Videography and Marketing Consent
By making a booking at Café Mambo, the person responsible for the booking acknowledges that photography, videography and other audiovisual content may be captured at the venue during events and activities.
The booking client consents to Café Mambo capturing and using content relating to the event for legitimate marketing, promotional, advertising and business communication purposes, including publication on social media platforms, the Café Mambo website and other marketing channels.
Such content may include venue imagery, event décor, entertainment, activities, food, group photographs and general event atmosphere.
The booking client is responsible for communicating the venue's photography and videography practices to their guests and bringing any objections or special privacy requirements to Café Mambo's attention before the event.
This consent does not override the privacy rights of individual guests, applicable data protection legislation or legal requirements relating to the use of identifiable images, personal information or images of children.
Café Mambo will handle objections and requests concerning identifiable content reasonably and in accordance with applicable law. Where necessary, separate consent may be required from individuals or the parents or legal guardians of children before identifiable images are used for promotional purposes.
Clients with specific restrictions regarding photography or marketing use must communicate these to Café Mambo in writing before the event so that reasonable arrangements can be discussed.
16. Intellectual Property
Unless otherwise indicated, the content on this website, including Café Mambo branding, logos, text, graphics, photographs and promotional materials, is owned by or licensed to Café Mambo.
You may view and use the website for personal or legitimate business enquiry purposes.
You may not reproduce, distribute, commercially exploit or use Café Mambo's branding or website content without prior written permission, except where permitted by law.
17. Website Use and Third-Party Links
You may not use this website for unlawful purposes, attempt to interfere with its operation, submit fraudulent information or knowingly introduce malicious software.
Our website may contain links to third-party websites or services. These are provided for convenience, and Café Mambo does not control their content, availability or privacy practices.
Your use of third-party websites is subject to their own applicable terms and policies.
18. Privacy and Personal Information
Café Mambo may collect personal information submitted through website forms, emails, telephone calls, WhatsApp communications and booking processes. This information may include names, contact details, event requirements, guest numbers and information reasonably necessary to prepare quotations, manage bookings, communicate with clients and provide our services.
Personal information will be processed in accordance with applicable South African privacy legislation, including the Protection of Personal Information Act 4 of 2013 (POPIA).
We will take reasonable steps to protect personal information and limit its use to lawful purposes. Information may be shared with relevant service providers where reasonably necessary to administer a booking or provide a service, or where otherwise permitted or required by law.
You may request access to or correction of personal information held about you, subject to applicable legal requirements.
Please refer to our separate Privacy Policy for further information about data collection, retention, security, cookies and your privacy rights.
19. Marketing Communications
Café Mambo may communicate with prospective clients and existing customers about enquiries, quotations, bookings and related services.
Promotional communications will be sent in accordance with applicable laws governing direct marketing and electronic communications. Where required, consent will be obtained before promotional communications are sent.
Recipients may opt out of marketing communications using the unsubscribe method provided or by contacting Café Mambo.
20. Limitation of Liability
To the extent permitted by applicable law, Café Mambo will not be liable for losses arising from a person's misuse of the website, reliance on information that has been superseded or matters outside Café Mambo's reasonable control.
Nothing in these Terms and Conditions excludes, restricts or limits any liability, warranty, right or remedy that cannot lawfully be excluded or limited under South African law.
21. Changes to These Terms
Café Mambo may update these Terms and Conditions from time to time to reflect changes in our services, website functionality or legal requirements. The updated version will be published on this website with a revised date.
Changes to website terms will not automatically amend an existing booking agreement. Any changes affecting a confirmed booking will be dealt with in accordance with that agreement and applicable law.
22. Governing Law
These Terms and Conditions are governed by the laws of the Republic of South Africa.
Any dispute will be dealt with by the appropriate court or other competent forum in accordance with applicable law.
